These Terms of Service ("Terms") constitute a binding agreement between you and Coogs 365 Sports ("we," "us," or "our") governing your access to and use of the website, subscription services, and related features (collectively, the "Service"). You must be at least 13 years old to use the Service. If you are under 18, you may only use the Service with the consent of a parent or legal guardian.

Coogs 365 Sports is an editorial publication covering University of Houston athletics. The Service includes freely accessible articles, paid subscription tiers that unlock exclusive coverage, a community forum, and related features. We may add, modify, suspend, or remove features at any time without notice.

Some features require a registered account. You agree to provide accurate information during registration, to keep your account credentials confidential, and to notify us immediately of any unauthorized access. You are responsible for all activity that occurs under your account. We use Clerk as our authentication provider; by registering, you also agree to Clerk's applicable terms.

The Premium tier is offered on a recurring subscription basis at the price disclosed at checkout. Subscriptions automatically renew at the end of each billing period until canceled. Payments are processed by Stripe, Inc.; by subscribing you also agree to Stripe's terms and privacy notice. You may cancel your subscription at any time from your profile page; cancellation takes effect at the end of the current billing period, and you retain access to premium features until that date.

Except where required by law, fees are non-refundable. We reserve the right to change subscription pricing with at least 30 days' notice before the change takes effect for existing subscribers.

Advertiser tier accounts are provisioned manually after an off-platform contact flow. Ad placement pricing, creative specifications, and campaign terms are set forth in a separate insertion order. We reserve the right to reject or remove any advertisement at our sole discretion.

If you post in the forum or submit any content to the Service, you grant Coogs 365 Sports a non-exclusive, royalty-free, worldwide license to host, display, and distribute that content in connection with the Service. You represent that you have the rights to do so.

You agree not to post content that is unlawful, harassing, defamatory, infringing, obscene, or intended to impersonate another person. We may remove content or suspend accounts at our discretion for violations of these terms.

All editorial content, photography, and design elements published by Coogs 365 Sports are the property of Coogs 365 Sports or our licensors and are protected by United States and international copyright laws. You may access and read the Service for personal, non-commercial use. You may not reproduce, republish, or redistribute our content without express written permission.

University of Houston trademarks, logos, and athletic identities referenced within editorial coverage are the property of their respective owners.

If you believe content on the Service infringes your copyright, please send a written notice to Coogs365@gmail.com containing the information required by 17 U.S.C. § 512(c)(3). We will respond to complete, good-faith notices in accordance with the DMCA.

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

To the fullest extent permitted by law, in no event shall Coogs 365 Sports, its affiliates, or their officers, directors, employees, or contractors be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of these Terms shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the event giving rise to the claim or (b) one hundred U.S. dollars (US$100).

You agree to indemnify and hold harmless Coogs 365 Sports from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, your user-generated content, or your misuse of the Service.

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may stop using the Service at any time. Provisions of these Terms that by their nature should survive termination will survive, including intellectual-property terms, disclaimers, limitations of liability, indemnification, and governing law.

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. Any dispute arising from or relating to these Terms shall be resolved exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction and venue in those courts.

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page and, for material changes, provide notice by email or in-product banner. Your continued use of the Service after the change takes effect constitutes acceptance of the updated Terms.
